1. Introduction
Welcome to DriftPaperQuill ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at driftpaperquill.sbs (the "Service") operated by DriftPaperQuill.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
DriftPaperQuill offers first-class yacht charter services, which include, but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All services are provided based on availability and prevailing weather conditions. We retain the authority to change or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you are required to:
- Be no younger than 18 years old
- Supply thorough and precise information
- Remit the necessary initial payment as highlighted in your reservation confirmation
- Consent to abide by these Terms & Conditions
3.2 Confirmation
A charter is considered confirmed only after we receive full payment and issue a formal confirmation. We maintain the discretion to decline service to any individual.
3.3 Availability
Charter availability depends on the accessibility of the vessel and optimal weather conditions. We will endeavor to accommodate your chosen dates and times as practical.
4. Payment Terms
4.1 Pricing
Pricing is listed in € and includes all applicable taxes, unless indicated otherwsie. Prices may be adjusted without advance notice.
4.2 Payment Schedule
- Deposit: 50% of the overall charter fee is due upon reservation
- Balance: Payable 48 hours before the charter's scheduled departure
- Any additional costs (if applicable): Due at the end of the charter
4.3 Payment Methods
We accept a broad range of payment options including major credit cards, direct bank transfers, and certified bank cheques. Payments are processed through secure, encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled more than 72 hours ahead of departure: Entire payment refunded, minus transaction fees
- If cancelled within 24 to 72 hours of departure: 50% refund
- If cancelled less than 24 hours prior to departure: Non-refundable
5.2 Weather Cancellations
In the instance of unsafe weather conditions, as determined by our captain, we will provide the option to:
- Reschedule your booking to an alternate available date with no extra cost
- Issue a full refund if rescheduling is not feasible
5.3 Mechanical Issues
Should there be mechanical issues with the designated vessel, we will strive to provide an appropriate replacement. If no substitute vessel is available, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
Every passenger must:
- Obey all directions given by the crew
- Use the provided safety equipment as needed
- Disclose any medical conditions that could impact their safety
- Stay within the vessel's designated areas
6.2 Prohibited Items
The following items are not allowed on the vessel:
- Glass containers
- Illegal substances
- Firearms or other weapons
- Pets (unless with prior approval)
6.3 Conduct
Passengers are expected to behave respectfully. We reserve the right to end a charter prematurely without a refund if a passenger's behavior presents a danger or interferes with others' enjoyment.
7. Liability and Insurance
7.1 Our Liability
We only hold liability up to the cost paid for your charter. We are not accountable for:
- Personal harm ensuing from passenger's own negligence
- Loss or destruction of personal belongings
- Indirect, incidental, or punitive losses
- Delays brought on by weather or other situations outside of our control
7.2 Insurance Coverage
Comprehensive maritime insurance is maintained to cover our vessels and operations. It is the responsibility of passengers to secure their own travel and personal insurance.
7.3 Assumption of Risk
By partaking in our yacht services, you recognize that all maritime activities carry inherent risks and you agree to accept personal accountability for your safety and welfare.
8. Modifications and Itinerary Changes
Itinerary alterations, routes, or schedules may be modified due to weather considerations, safety, or operational needs. We will make every attempt to provide comparable alternative experiences where feasible.
9. Force Majeure
Events outside our control, including but not limited to severe weather, natural disasters, governmental regulations, port closures, or mechanical failures, do not hold us liable for any delays, cancellations, or changes.
10. Privacy and Data Protection
Your personal data will be managed according to our Privacy Policy. You consent to our collection and use of your information as outlined when you engage our services.
11. Intellectual Property
All materials on our website, such as text, visuals, logos, and images, are protected by copyright and trademark laws. Unauthorized reproduction, distribution, or derivation of these works without our express consent is prohibited.
12. Governing Law
The applicable laws of France govern these Terms. Any disputes will be adjudicated in the courts situated in Cannes, France.
13. Changes to Terms
We retain the right to adjust these Terms at our discretion. Any amendments will be communicated on our website along with a revised date of implementation. Your continued utilization of our services signals your acceptance of the amended terms.
